These terms and conditions outline the rules and regulations for Leigh-Anne’s Flower Cake Design. 

By placing an order or making a payment directly to us, you agree to our terms and conditions. As we may change these terms from time to time. The terms that apply to you are those posted on our website on the day you secured your booking with us. We advise you to print a copy for your records. Please read them carefully.

Interpretation:

- I, we, our, us, the company – Leigh-Anne’s Flower Cake Design.

- You, your, customer, client, person - means the individual who purchases goods, utilizes our services, or visits our platforms.

- Order, Price - refers to a verbal or written request for goods to be produced, supplied, and paid for by you.

- Retainer fee - denotes a non-refundable and non-transferable fee paid in advance to reserve a date and order, deducted from the order balance.

- Third parties, a third party - refers to individuals not directly involved in the contract, such as venue staff, florists, planners, stylists, family, friends, etc.

- Goods, products, cake, dessert, food, sugar flowers, wafer flowers, design - denotes perishable goods ordered.

- Bespoke - crafted and personalized specifically for you.

1. WEBSITE USE:

1.1 Cookies are used on our website solely for monitoring and improving our business. Full details can be found in our Privacy Policy at https://www.leigh-annesflowercakedesign.com/privacy-policy.

1.2 You must not use, publish, sell, rent, or copy any material from Leigh-Anne’s Flower Cake Design without our written permission.

1.3 If you link our business to your website or any other third-party platform, we reserve the right to accept, refuse, or request its removal. Any linking must not damage our reputation.

1.4 Our website is free to view and explore our services, and it is regularly maintained and updated. Changes to our website, services, and goods may be made without notice. You will be informed in detail if these changes affect you. We are not liable for any loss or damage resulting from viewing our website or changes made to our products or services.

2. ORDER CONTRACT & COMMUNICATION:

2.1 Your order contract constitutes an agreement between you, the client named on the contract, responsible for ordering and paying in full for services, and Leigh-Anne's Flower Cake Design, providing the agreed services. Third-party payments do not alter the original contract. The named client must share these terms with others, and only they can give instructions and requests for the order, regardless of who pays or organizes the event.

2.2 Upon direct BACS payment by the client to Leigh-Anne's Flower Cake Design (using the business bank account of Leigh-Anne Walton, account number 755741343, and sort code 608371) and receipt of an email confirmation of the booking from us, Leigh-Anne's Flower Cake Design agrees to be legally bound by the terms and conditions outlined in this agreement. The client, upon completion of a direct BACS payment to Leigh-Anne's Flower Cake Design and receipt of an email confirmation of the booking, agrees to be legally bound by the terms and conditions outlined in this agreement.

2.3 Our primary mode of communication is through our business email at hello@leigh-annesflowercakedesign.com or our website. Please regularly check your spam/junk folder for correspondence. Our communication is legally binding and serves as a signed and dated agreement.

2.4 Bespoke experience has a minimum order spend of £950.00 which can include desserts & favours but excludes delivery and set-up charges, and cake stand hire which is an added charge. Dates can be secured with a £200.00 retainer fee which is non-refundable/non-transferable which ensures your date is booked with us and will be deducted from the order balance. ​Bespoke experience: I aim to provide you with a personalised, bespoke experience that is both simple and stress-free. All instructions will be kept via email once booked to ensure that no details are missed, as everything is organised and recorded.​ If you choose to work with a wedding planner, they can facilitate all of the following arrangements. It's important to note that the individual specified in the contract is the person from whom I will take instructions.​ Initially, I will provide you with a proposed cost estimate until your design is finalised. If you are happy to proceed, I will then forward our up-to-date terms and conditions document to you, along with instructions for submitting a non-refundable/non-transferable retainer fee of £200 to secure your booking. This payment serves as an agreement to the contract and will be deducted from your final balance. After securing your bespoke experience booking with us, you can schedule a complimentary, informal 30-minute virtual consultation via Zoom or email around 6 months before your wedding day. During this session, I will work closely with you to finalise your bespoke design, ensuring it perfectly aligns with your vision, preferences, and taste while fitting within your budget. Taking inspiration from your colour palette, floral arrangements, invitations, themes, venue décor, or any other details that resonate with our style, I will digitally sketch two bespoke wedding designs and provide tailored proposals. You will have 14 days to refine the final design once you receive the sketches. Following this, you will receive our complimentary signature wedding taster box worth £65.00, which includes two sample portions of 8 of our luxury flavours to help you choose your favourites. These samples are shipped via Royal Mail 24-hour tracked service on selected dates in January, April, July, and October, with shipping and handling charges included at no extra cost.​ Once you’re ready to proceed, I will send you a completed order form along with an invoice detailing the balance due, minus the retainer fee paid to secure the booking. The remaining balance will be due 8 weeks before your wedding day, payable by bank transfer. Please note that no changes can be requested after this date. Once arrangements are in place, I will liaise with your chosen suppliers regarding your wedding cake, ensuring a seamless process leading up to your big day. On the wedding day or delivery day, I will deliver and set up your cake at the venue at an agreed time, providing your catering team or venue coordinator with details regarding allergens, as well as cake and cutting specifications.​​​​​Additional wedding taster boxes are extra and are non-refundable. If you would like to sample our complimentary wedding taster box before you look into securing your order, they are available for £50.00 each on the dates listed above and are subject to availability. Please note that additional sample boxes are an added extra, not to be deducted from an order, and are non-refundable. It also doesn't guarantee availability for your bespoke booking. We will only provide up to 3 sketches per bespoke wedding design. After this, additional wedding consultations cost £100, additional sketches cost £50.00 each, and re-designs cost £50.00 each which all must be paid beforehand. 10-weeks before your delivery day is the last date to request any changes to be made to your order. All of our designs must not be; used, shared, published, sold, or copied by you or other third parties without our written permission, you will be held liable if you do so)

2.5 Standard size tiers are approximately 5" high, coated in a white Belgian chocolate ganache, and iced in a white luxurious Swiss fondant. ​Guide price is an example of a simple to opulent design with standard tier sizes in our signature style, each bespoke design is unique the total price will vary by the date required, the size and the servings required as we have various tier sizes available, and the complexity and intricacy of your chosen design. We will only be able to provide you with an accurate proposal after your bespoke design has been finalised which will take place no sooner than 6 months before your wedding day, once you have secured your booking with us. We will happily give guide prices of what you could expect to pay before booking, and prices of our previous bespoke designs as an example. 

2.6 Special bakes may be made from time to time. These are not bespoke and produced in high quantities therefore, no flavour or design can be changed. Full payment is required at the time of ordering. All orders from the Special Bakes Menu are non-refundable/non-transferable.

2.7 Prices are non-negotiable. If a quote you have received is higher than your price range, we might be able to adapt the design to lower the price. The minimum order spend will still apply. Prices are subject to change at any time. Favours/Desserts prices vary based on your specific needs with a minimum order of 24 each, then sold in multiples of 12 after.

2.8 No date is secured until the non-refundable/non-transferable retainer fee or full payment has been paid, and you have received an email booking confirmation.

2.9 We will do our best to match your preferred colour or design, but it may not be the same. The colour brands may vary and photos may not depict the true colour. Additionally, every cake designer has their unique style and techniques.

2.10 1 week before the final invoice is due is the final date for requesting changes to the order. Changes may result in extra charges and cannot be guaranteed. The remaining balance must be paid by the due date mentioned in the contract, otherwise, the order will be cancelled. See cancellations for further details.

2.11 Before placing an order, make sure to verify all details on the order form and read and understand our terms and conditions. You will receive a copy of our latest terms and conditions with the retainer fee invoice. Keep the file safe. Changes to our terms and conditions may occur, but won't impact your original order unless changes are made to it. Any changes to your order will require an administration charge of £10.00 and a re-design charge of £20.00, to be paid upfront.

2.12 Payments are to be made, via BACS transfer to the business account only. Further details can be found on the order invoice. Please state in the reference section; your surname and the order number. Failing to do this could result in your retainer fee being missed and the date you require not being secured. We are not liable for any payment errors and date availability.

2.13 We do not take orders where a sheet cake is being served by another supplier, this is to protect our reputation.

2.14 For reasons out of our control, such as stock availability or extreme weather conditions like a heat wave, we may need to; adapt the order by changing the cake design, and flavours, or adjusting our recipes. We may also need to provide you with a display cake and a sheet cake to serve to your guests. If any changes affect your order, you will be informed of such changes, and we will recalculate the order value and will charge you or refund you any monies owed. We are not liable for such changes and you will have no additional claim against us either under this agreement or by statute or common law, or for any financial loss (including revenue, goodwill, profits, anticipated saving, business opportunity, or any injury to your reputation) incurred after such action has been taken.

2.15 If we owe you money, we will credit you as soon as reasonably practicable.

2.16 If by mistake we have under-priced any goods on the order, we will not be liable to supply those goods to you at the stated price in the contract, providing we notify you 28 days before the collection/delivery. Any price correction must be paid before collection/delivery.

2.17 If we owe you money, we will credit you as soon as reasonably practicable to the original payment method.

3. ALLERGEN, INTOLERANCES & DIETARY INFORMATION:

3.1 Due to the high risk of cross-contamination in our kitchen, we cannot accommodate food allergies, intolerances, or other dietary restrictions. We strongly advise customers with such concerns to refrain from consuming our products. Our products may include or come into contact with the following ingredients: Allergens; wheat (gluten), milk, eggs, nuts, peanuts, soy, sulphur dioxide, sulphites, and sesame seeds. Additionally, they may contain cherries, coconut, dates, mango, oranges, strawberries, sunflower seeds, alcohol, and gelatine. Please be aware that our products may also contain food additives, including E numbers such as E102, E104, E110, E122, E124, and E129, which may have adverse effects on activity and attention in children. Please contact us at hello@leigh-annesflowercakedesign.com if you need any additional information or have other questions.

3.2  It's yours and other third parties' responsibility to follow the Cake Care Serving Guide, we are not responsible for ill health due to not following the information provided.

​4. SERVINGS:

4.1 The serving size mentioned is an estimate only and is calculated based on a standard wedding serving of dimensions 1 x 1 x 5 inches and a standard celebration serving of dimensions 1 x 2 x 5 inches. Cake servings depend on how it's cut. If you hire a third party to serve, inform them of the guest count and whether you want to retain any tier or sugar details. We are not liable for serving errors or damage to sugar details.

4.2 It's your responsibility, as well as that of any third parties involved, to follow the Cake Care Serving Guide. We are not responsible for serving errors resulting from failure to follow the provided information.

4.3 Our bespoke goods can be delicate due to their light textures and fillings, so it is essential that you or the third party you appoint follow our serving guide to achieve the perfect slice. Place a cutting board against the side of the cake, and using a long sharp knife, slice a 1" thick slice of the cake all the way down. Lay the large slice of cake flat and cut 1" strips, repeating until the cake is consumed. Carefully clean the knife with a damp cloth after each slice. Cakes are best served on plates with cutlery. We are not responsible for the serving of the cake or any errors that may occur.

5. OUR ARTISTIC STYLE:

5.1 As a cake artist in my own right, with my creative artistry and craftsmanship, I do not replicate designs of any sort created by another company. However, we may use such designs as inspiration only and will recreate details our way, consistent with Leigh-Anne's Flower Cake Design signature artistry style.

5.2 I do not accept requests for copyright-protected characters, brands, or any other novelty-type cakes. We do not create naked, semi-naked, or buttercream-finished cakes, nor do we use fresh flowers or fruit on our designs.

5.3 We reserve the right to modify your bespoke goods at any time without seeking permission.

5.4 We exclusively own the rights to our bespoke designs and sketches created by us. These are copyright protected and owned by Leigh-Anne's Flower Cake Design indefinitely. We have the right to share such images of our designs and sketches across social media, websites, and for marketing purposes without seeking your permission or compensating you.

5.5 You or other third parties must not add any additional decorations to the cake. Liability will be attributed to you if you do so.

5.6 Although we create our bespoke designs to the best of our ability, there may be slight imperfections, and there may be a seam up the back. The front of the design will always be the best side to display. As our designs are handcrafted or piped, colours and quality of workmanship can vary, and no two are ever the same

5.7 Polystyrene dummies are not environmentally friendly. We may only use them if necessary to enhance the design, not to lower the price.

6. STORAGE:   

6.1 A sturdy table is required to hold heavy cakes, and it is the responsibility of both the customer and the venue to arrange it. The table must be available for delivery/set-up, along with other items like a tablecloth and cake stand. We do not recommend moving the cake after set-up, and we are not liable for any damage or health issues.

6.2 To ensure the quality and taste of the cake, it is important to follow proper food storage advice. Cakes should be kept away from direct sunlight and heating elements, in an environment with 30-50% humidity and temperatures between 18-21ºC. Avoid storing them in a fridge/freezer, hot/damp kitchen, conservatory, or marquee. After cutting the cake, wrap it in cling film and store it in a cardboard box. You are responsible for providing a suitable storage place, as we are not liable for any cake spoilage caused by poor storage conditions.

6.3 Our food products are best consumed on the agreed delivery date. We are not responsible for any negative effects or poor taste if consumed after that date.

6.4 It is yours and other third parties' responsibility to follow the Cake Care Serving Guide. We are not responsible for ill health or damage due to not following the information provided.

7. CAKE STAND HIRER:

7.1 Cake stands are available for hire starting from £35 each, with a £100 deposit required. The deposit will be refunded upon the return of the stand and packaging in good condition by the agreed-upon time. Please note that you are responsible for returning the items, and any damages or late returns may result in the loss of the deposit. Please be aware that we cannot be held liable for any lost deposits.

8. COLLECTION/DELIVERY:

8.1 As our tiered cakes are delicate and require assembly at the venue, Leigh-Anne offers delivery and setup services to ensure your cake arrives in perfect condition. Delivery charges are based on your bespoke design, location, and the time/day of delivery, with additional charges for Bank Holidays and Sundays. Delivery and set-up start from £79.00. Our standard delivery covers venues within a 45-mile radius of our business address, with setup typically taking 1-1.5 hours. We charge 65p per mile for the return journey from our business address, along with an hourly rate.

8.2  Orders up to one tier can be collected during our business hours (Mon - Fri, 10 am - 4 pm) and you are responsible for their safety once collected. We recommend appointing an able person to carry the food products and transporting them in a vehicle on a non-slip mat on a flat surface in the boot. Do not place the cake on a seat or a person’s lap. It is recommended to cool the car for at least 30 minutes before collection in hot weather to avoid any damage to the cake decoration and structure. Driving slowly is advised. We are not liable for any damage to the cake(s) in your care.

8.3 If collecting from the business premises, the collection date and time will be stated in the contract, early collection is not possible under any circumstance. Whilst on the business premises, you are liable for any damage to goods, business equipment, and premises of the trading address.

8.4 We need easy access and private space to work at the venue. We require entry 3 hours prior to the food products being required. In case of hot weather, the set-up time may change, and it is your responsibility to make the necessary arrangements. We won't be responsible for any miscommunication or disorganization with you or other third parties.

8.5 it's important to inspect your bespoke goods before we set up at the venue. If no one is present, we'll assume you accept the order and the food was delivered in perfect condition. We'll take pictures as evidence. Once we leave, the food is your responsibility and we aren't liable for any damage.

8.6 We will try our best to meet the delivery date and time, but in the event of circumstances that are out of our control such as an illness, accident, breakdown, traffic delays, or severe weather. We will contact you and arrange an alternative time with you. We will not be liable for any damage or loss due to the delay in the delivery arising out of our control.

8.7 If you are unable to collect your order at the agreed time and date, it is your responsibility to let us know. We will re-arrange a new date and time for a collection that is convenient to us both, however as food products are perishable, we will not be liable for the deterioration of the design or the taste of the food products. We will not offer a refund or replacement.

8.8 Cakes and decorations are extremely fragile and there is a very high risk of damage to the cake due to the weather, accidents, or whilst delivering or collecting and you accept these risks. If damage to the cake is made in our care, we will try to repair the damage. If we can repair the damage or replace the goods, we will do so. In the event the damage cannot be fully repaired, we will take appropriate action and will compensate you accordingly. You will have no additional claim against us either under this agreement or by statute or common law, or for any financial loss (including revenue, goodwill, profits, anticipated saving, business opportunity, or any injury to your reputation or event) incurred in respect of the damage after such action has been taken. If the food products are damaged in your care, we are not liable and cannot guarantee we will be able to fix any repairs. If we can repair any damage there will be a charge to cover the hourly rate, travel, ingredients, etc.

9. NON-EDIBLE ITEMS:

9.1 You'll be informed of the non-edible items present in and around food products. Before serving, it is your responsibility to share this information with third parties. Non-edible items in cakes will be food-safe or have a food-safe barrier for hygiene reasons.

9.2 It is your responsibility to inform the person(s) in charge of cutting the cake if you wish to keep any items.

9.3 Sugar flowers will keep for a long time if stored correctly; these are very fragile and must be carefully stored away from sunlight and humidity. Deterioration will occur over time, and we are not liable for any damage or deterioration of non-edible items.

9.4 Do not add any decorations to the cake that are not food-safe or do not have a food-safe barrier. If you do, you will forfeit your right to file a complaint, and we will not investigate any complaints. We are not liable for any damage, contamination, ill health, or poor design caused by you or other third parties.

9.5 We are not liable for any errors or incidents incurred due to non-edible items.

9.6 It is yours and other third parties' responsibility to follow the Cake Care Serving Guide. We are not responsible for any ill health resulting from not following the information provided.

10. CANCELLATIONS:    

10.1. In the event of cancellation, retainer fees paid to secure your bespoke experience order are non-refundable/non-transferable regardless of how much notice is given. If you terminate your contract agreement before your order is due 8 weeks or less 100% of the total order value is still to be paid to us. Any purchased wedding taster boxes are also non-refundable. For more information refer to the Terms and Conditions that will be sent to you via email before booking..

10.2 If you cancel your special bake order before the date of the collection/delivery you will lose any payments made, and you will receive no refund.

10.3 We are not accountable for any cancellations made by you, even if we have to cancel your order for you not meeting the payment deadline or breaching the terms and conditions.

10.4 If we are forced to cancel your order due to poor health, sickness, family bereavement, etc. we will try to give you as much notice as possible and will refund you in full, including any fees and any additional wedding taster box fees paid. We are not liable for any inconvenience caused or for any financial loss (including revenue, goodwill, profits, anticipated savings, business opportunity, or any injury to your reputation or event incurred due to us cancelling your order.

10.5 If we are forced to cancel your order due to a difference of opinion, or you have not complied with these terms in place we will follow the refund procedure set out in 10.1.

10.6 If an unexpected force majeure event or circumstances that prevent us from performing our contractual obligations such as natural causes, weather, act of God, flood, fire, storm, explosion, leak, transport, energy, war, invasion, civil unrest, terrorism, riot, labour strikes pandemic, revolution, casualty, accident, shortage of raw materials, water, energy, breakdown of plant or machinery,  default of suppliers or subcontractors etc. we are not liable to you. We will look at rearranging the order to a later date free of charge if possible. All dates are subject to availability. No refunds will be given.

10.7 If cancellation action was taken, you will have no additional claim against us, either under this agreement or by statute or common law.

11. PHOTOS:

11.1 We may use photographs of our designs for marketing purposes without compensating you. Your personal information will not be shared without your permission.

11.2 Send us an email with a photo of your bespoke wedding cake to allow us to share it for marketing purposes.

12. COMPLAINT PROCEDURE:  

12.1 It is your responsibility to inspect the condition of your order upon collection or delivery/set up. Raise any issues with us within 6 hours. Complaints regarding the design must be made in writing via email at hello@leigh-annesflowercakedesign.com and only by the client named on the contract. Sealed food packaging must be intact, and 100% of the food products must still be present for investigation. Complaints about the quality of the cake require 80% of the food products to be present and returned within 24 hours for investigation. Once more than 20% of the food products have been consumed, this confirms that you were satisfied with the order, and no complaint will be investigated or refunded. Personal taste preferences will not be investigated or be eligible for a refund.

12.2 You must allow us 28 days to respond to your complaint, and you must not try to damage our reputation, either through word of mouth or online, regarding your order.

12.3 Abuse will not be tolerated. If we feel subjected to it, we may refuse or cancel orders, block you on social media, and void any complaint. Cancelled orders due to abuse will be treated as cancelled by you, and refunds will follow the cancellation policy.

12.4 We are not responsible for any inconvenience or financial loss, including damage to reputation, resulting from the complaint.

12.5 If compensation action is taken, you won't have any additional claim against us under this agreement or by law.

12.6 If you make false statements that could damage our business reputation or personal character, we may take legal action.

12.7 Refunds will be processed as outlined in section 10, CANCELLATIONS.

13. DATA:

13.1 Our privacy policy fully complies with the Data Protection Act 2018, and we will store your data for the necessary duration, ensuring its safety. For more details or any queries, refer to our privacy policy or reach out to us.

13.2 You must not share, sell, or use our personal or business information. Safely destroy it after the necessary time.
